Terms of service

Terms and Conditions

1. Scope
These terms apply to all orders placed by consumers in the online shop foundationberlin.de. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. The seller is the provider named in our legal notice.

2. Conclusion of contract
The presentation of products in the shop is not a binding offer. By clicking the order button you submit a binding offer to buy the products in your cart. Before you submit your order you can review and correct your entries in the cart and at checkout. The contract language is English. We store the contract text. You can view these terms at any time on our website, and you will receive your order details by email after you place your order.

3. Prices and payment
All prices are final prices in euros. Shipping costs are shown before you place your order and are described in our shipping policy.

As a small business owner pursuant to § 19 UStG, we do not charge VAT and therefore do not show it.

The payment methods available are shown at checkout. Payment is due when you place your order unless the payment method states otherwise.

4. Delivery
We deliver to Germany. Delivery times and costs are described in our shipping policy. If an item is not available, we will inform you without delay and refund any payment already made.

5. Retention of title
The goods remain our property until they have been paid in full.

6. Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in our refund and withdrawal policy. Consumers can also exercise their right of withdrawal online using the “Withdraw from contract” function in the footer of our shop.

7. Statutory warranty
The statutory warranty rights apply.

8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. In cases of slight negligence we are only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Mandatory statutory rights remain unaffected.

9. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

10. Final provisions
If individual provisions of these terms are invalid, the remaining provisions stay valid.
